Terms & SMS Terms

1. Agreement
These terms govern your use of the local home-service websites, phone numbers and text messaging operated by ARKennedy LLC, doing business as Webleads ("Webleads", "we", "us" or "our"), and of the Webleads back-office application. By using them, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use them. These terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules, and any dispute will be heard in the state or federal courts located in Utah.
2. SMS Terms
Program 1: service-request messages
People who request service through one of our local websites and agree to receive texts get text messages about that request: confirming that it arrived, arranging a call, visit or estimate, and following up on the work. These messages are sent under the name of the website where the request was made.
Program 2: contractor messages
Business owners who agree to receive texts from Webleads get text messages about working with us, such as new service requests sent their way, scheduling and account notices.
For both programs
Consent is not a condition of purchase. You can cancel at any time: reply STOP to any message and we will send one message confirming that you have been unsubscribed, and no further messages after that. If you want to join again, you can sign up the same way you did the first time. Reply HELP for help, or email support@webleads.app.
Message and data rates may apply. Message frequency varies. Carriers are not liable for delayed or undelivered messages.
Mobile information is not shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. Our Privacy Policy explains how we handle the information you give us.
3. Use of the sites
Our websites connect homeowners with independent, licensed local contractors. Those contractors are independent businesses, not employees or agents of Webleads, and each one is responsible for its own estimates, work, licensing, insurance and warranties. Any agreement for work is between you and the contractor. You agree to give accurate information when you make a request and not to use our websites, phone numbers or messaging for anything unlawful, abusive or misleading, including sending spam or trying to break into our systems. Access to the Webleads back-office application is by invitation only and is subject to any separate agreement we have with you.
4. No warranty
Our websites, phone numbers, messaging and application are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that a contractor will be available for every request, or the quality, timing or price of any contractor's work.
5. Limitation of liability
To the fullest extent the law allows, ARKennedy LLC and its owners, employees and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of our services or from any work performed by an independent contractor. Our total liability for any claim relating to our services will not exceed one hundred US dollars ($100).
6. Changes
We may update these terms from time to time. When we do, we will change the effective date at the top of this page. Continuing to use our services after a change means you accept the updated terms.
